Scope and purpose of personal data processing

Your personal data will be processed:

  • in order to take the steps necessary to conclude a contract at your request - article 6(1)(b) GDPR,

  • to the extent required by law, in particular the Polish Labour Code regulations - in order to carry out the recruitment process - Article 6(1)( c ) GDPR,

  • in the event that the Candidate provides other data than that are required by law - on the basis of his/her consent, in order to carry out the recruitment process - Article 6(1)(a) GDPR, and in the event that special category data is provided, also Article 9(2)(a) GDPR,

  • for the purposes of PDC's legitimate interest to establish, assert or defend against claims - Article 6(1)(f) GDPR, and in case special categories of data are provided, also Article 9(2)(f) GDPR,

  • where additional consent is given for inclusion in future recruitments - Article 6(1)(a) GDPR.

 

According to Article 221 of the Polish Labour Code: “§ 1. An employer may demand a person applying for employment to provide the following personal data, including: 1) name(s) and surname, 2) names of parents, 3) date of birth, 4) residential address (address for correspondence), 5) education, 6) employment history. § 2. An employer may also demand an employee to present, regardless of the personal data referred to in § 1 points 4-6, if it is necessary.” This is the scope of personal data required by definition - the obligation to provide other data may result from specific legal provisions.

 

NOTICE: the provision of information by the candidate that exceeds the minimum data scope governed by employment law is clearly an action equivalent to consent to the processing of that data for the purpose of recruitment under Article 6(1)(a) of the GDPR. Their provision does not affect your ability to participate in the recruitment.

 

Obligation/voluntariness to provide data

You are required by law to provide data with regard to your name, surname, date of birth, contact details and, where this is necessary, for the performance of a certain type of work or for a certain position, also data regarding your education, professional qualifications and previous employment history, or other data that is required by other legal provisions. The provision of data in other respects is voluntary. If you do not provide the personal data required by law, your application will be rejected.

 

Means of data acquisition

As a general rule, your personal data is acquired from you. Exceptionally, in the case of your prior consent, your personal data has been provided to us by entities specialising in recruitment, within the framework of a recommendation system or by persons providing references. Duration of personal data processing

Your data will be processed by the Personal Data Controller for a 3-month duration after the end of the currently conducted recruitment process, and in the case of granting consent to participate in future recruitments - for a 24-month duration after the end of the currently conducted recruitment process.

 

The Personal Data Controller plans to carry out recruitment for a duration of no more than six months. If it is necessary to assert or defend against claims, your data will be processed for the duration necessary to assert or defend against them.

 

Your rights

You have the right to:

  • access to your personal data and to receive a copy of your personal data,

  • to rectify (correct) your personal data,

  • to restrict the processing of your personal data;

  • erasure of your personal data,

  • object to the processing of your personal data,

  • transfer of your data,

  • withdraw of consent - if the data is processed on the basis of the consent given,

  • file a complaint to the President of the Personal Data Protection Office (to the following address: Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw).

 

Transfer to third countries

As a general rule, your personal data will not be transferred outside the European Economic Area (hereinafter: EEA). However, having regard to the services provided by the Administrator's subcontractors upon the support for ICT services and IT infrastructure, the Administrator may outsource certain activities or IT tasks to recognised subcontractors operating outside the EEA, which may result in the transfer of your data outside the EEA.

 

Recipient states outside the EEA, in accordance with the decision of the European Commission, shall ensure an adequate level of protection of personal data in accordance with EEA standards. For recipients in the territory of countries not covered by the European Commission's decision, in order to ensure an adequate level of such protection, the Controller shall contract with the recipients of your personal data, based on the standard contractual clauses issued by the European Commission, in accordance with Article 46(2)( c ) of the GDPR.

The security measures applied by the Controller for your data comply with the principles provided for in Chapter V of the GDPR. Duration of personal data processing

Your data will be processed by the Personal Data Controller for a 3-month duration after the end of the currently conducted recruitment process, and in the case of granting consent to participate in future recruitments - for a 24-month duration after the end of the currently conducted recruitment process.

 

The Personal Data Controller plans to carry out recruitment for a duration of no more than six months. If it is necessary to assert or defend against claims, your data will be processed for the duration necessary to assert or defend against them.

 

Your rights

You have the right to:

  • access to your personal data and to receive a copy of your personal data,

  • to rectify (correct) your personal data,

  • to restrict the processing of your personal data,

  • erasure of your personal data,

  • object to the processing of your personal data;

  • transfer of your data,

  • withdraw of consent - if the data is processed on the basis of the consent given,

  • file a complaint to the President of the Personal Data Protection Office (to the following address: Urząd Ochrony Danych Osobowych, ul. Stawki 2, 00-193 Warsaw).

 

Transfer to third countries

As a general rule, your personal data will not be transferred outside the European Economic Area (hereinafter: EEA). However, having regard to the services provided by the Administrator's subcontractors upon the support for ICT services and IT infrastructure, the Administrator may outsource certain activities or IT tasks to recognised subcontractors operating outside the EEA, which may result in the transfer of your data outside the EEA.

 

Recipient states outside the EEA, in accordance with the decision of the European Commission, shall ensure an adequate level of protection of personal data in accordance with EEA standards. For recipients in the territory of countries not covered by the European Commission's decision, in order to ensure an adequate level of such protection, the Controller shall contract with the recipients of your personal data, based on the standard contractual clauses issued by the European Commission, in accordance with Article 46(2)( c ) of the GDPR.

The security measures applied by the Controller for your data comply with the principles provided for in Chapter V of GDPR. Profiling

Your personal data will not be used for profiling or for automated decision-making of any kind towards you.
